State Court to Determine Employer Liability for Workers Contracting COVID-19

Will employers be responsible for workers contracting COVID-19 on the job and spreading it?

California’s top state court has agreed to take a case that will determine whether companies can be held liable under state law when their workers contract COVID-19 on the job and spread it to their relatives, Reuters reports.  

This decision was a response to a case brought by Corby Kuciemba, who says she became seriously ill with COVID-19 after her husband was exposed to the virus at his job with Victory Woodworks Inc. in San Francisco. 

The decision California’s top court makes regarding the case may be setting a new precedent for business owners and employees in this COVID-19 pandemic era. However, many business groups are opposed to the idea of liability, saying it will prompt lawsuits not only by a worker’s family and friends but also by anyone infected by that circle of people.
